thanks guys. i wished there was any interim EAD to continue work.
I agree would have been nice. I know people that had to quit working and then come back online once the EAD came through of course the employer worked with them as far as rehiring is concerned but its just not easy to not see the pay checks coming in regularly.

I am EB2, Indian. Filed for PERM earlier this summer and waiting for approval which I don't expect for another 4-6 months. The situation is that my company is in a very shaky financial position but they have been very supportive and I am hoping to be okay for the next 6 mo to year. My strategy is (assuming I don't lose my job) to just sit out my I-140 approval and that way I get the 3-yr extension and lock in my PD. I don't see being able to file for I-485 at this job.
Soo -- 2 questions:
1) Do you think the financial position of the company will affect the I-140 approval? It's a financial services firm and we have had a bunch of layoffs.
2) Assuming I get my I-140 approved, could I, in theory, leave the US for a while (I am very interested in a one-year fellowship program in Europe) and then come back and go work for a new company using the 3-year H1-B extension and begin the green card process again with my current (2009) priority date?

For question 2: Answer Yes.
If your company had lay offs there is a good chance you might get audit. If you get an audit the Perm process might take upto 2-3 years. If you dont get an audit perm process could finish in a year. Plan accordingly. All the best.

Hello Guys,
I never received FP notice and got EAD/AP almost three weeks back. Is there a need to worry? or just wait..
My application reached to texas..they transfered to Cal...cal issued the EAD/AP and senta transfer notice for 485 to nebraska..didn't hear anything from nebraska..

Hi, I am on At Will Employment, employer laid off on April 30 2009. I had seen in discussions, if employer laid off we an ask him for Return Flight Tickets. I need to confirm because i was on At Will Employment.

If this can be done,
1. Tell your employer to give you one month vacation and keep you on the payroll. In that case, you can start applying for a job and if you get a job you should be saved. You would have to call employers rather than depending on rectruiters
2. If possible change to F1 visa,
3. Promptly apply for canadian immigration and move to canada, since you were in US in H1B there are high chances you would get a canadian PR within 6-8 months.
4. At least complete the FBI clearance when you are at US to apply for canadian PR.
5. Check for other oppurnities.
However,
1. Describe your skillset and the nature of work. Maybe someone from IV would help you.
2. Ask for help if you need something. Most of the IV members i got in touch are really helpful. In turn i have helped few of them.

With the first question what it sounds like you want to do is open your image (you may have to copy and paste it into a new document, not sure)...
Select the layer with your image then go to Image/Adjustments/Hue Saturation (this is in Photoshop 7, it is still under the Image menu in 6, but Adjustments was named something else, which I forget now)
Then check the colorize checkbox and slide the sliders to the color you want.
As for your second question, yes it is possible. You can use the Lasso tool. If you have the toolbar pallette open, it is the tool right under that Rectangle Marquee tool. You can right click on the lasso tool to choose between 3 different types of lassos. The rounded one is to select an area freehand style, the jaggety one is to select an area by clicking points, and the one with the magnet allows you to better outline things.

My husband's employer filed for green card under EB-1 (OR). I-140 got approved, I-485 is pending. I already did my fingerprinting. My husband's is scheduled for next week. We did not get EAD or AP yet.
Meanwhile I need to travel to Europe on business. I have a valid H-1 to re-enter US. Would my AP get approved before I return to US? If so, can I still enter with my valid H-1? My husband is planning to delay his biometrics until I get back. Are there any problems with this plan? Please advise

H4 is completely depends on your H1, does not matter if it is an extension or new. If you have good to take it with other documents, if not, I don't think thats a problem. As long as you have all your H1 documents ready, she will get it.

Hold on there. Why exactly do you need to file EAD and AP now? Once you get 140 and 485 receipt notice, you can apply online yourself. Then you will get your own EAD to your own home.
Then the questions is - would you be able to get a copy 140 and 485 receipt notice from him?

I just checked the copy sent to me from my law office. It says I-485 pending for the current status. I got the EAD renewed without any problem.
I saw somewhere that you can alos write AOS pending.

I don't think your lawyer knows what he's talking about. All you need is your I-140 receipt. I applied for my wife on July 2 and used my I-140 approval notice. Did not even include the I-485 notice as the instructions did not ask for it. The simple solution is to go online and download the official instructions and figure out for yourself.
I got myself in somewhat of a mess here and wondering if there is any solution?
I filed for my I-485 on June 28th and it reached UCSIS on 2nd July. I wasn't able to do the same for my wife as she was in India at that time.
She is back now and I want to file her I-485 but my lawyer tells me I can not do that because it either needs to be filed concurrently with mine or they need to have a receipt for my I-485 which doesn't seem to be coming in the next few weeks.
Is there anything else I can do? Anyone has similar experiences? Will a copy of my I-485 filing do?

My wife is currently on H1 (valid until Oct 2008). We just had a baby and I am thinking of transfering her to h4 (COS) for about 7-8 months. Once she feels comfortable she would like to start working again. In this case we would need h4 to h1b COS again.
Ques 1: Will h4-to-h1 transfer (while the h1 visa is still valid) be counted against a fresh quota or will this be just a COS application.
Ques 2: This is her first H1B which was valid for 3 years ( started in Oct 2005 - Oct 2008). Her company is about to file for renewal (for another 3 years - then her H1B maybe valid until Oct 2011). If she does COS to H4 now (June 2008) and if she plans to COS to H1 next year (Lets say March 2009), then will her new H1 application still be considered against the H1B cap ? The reason I ask is cos her H1B is currently valid until Oct 2008 and her company hasnt applied for renewal yet.
Ques 3: How much time does it takes to get the COS for h1-h4 and h4-h1 ?
