U.S. Citizenship and Immigration Services (USCIS) has launched its newly re-designed Web site (http://www.uscis.gov/portal/site/uscis). Although the Web site update was scheduled to be introduced September 22, 2009, attorney Eugenia Ponce visited the site Monday and has this report:
The updated Web site is organized according to categories.The categories are displayed as Topics, Forms, Resources, Laws, News, and About Us. The topics are categorized as follows: Adoption, Permanent Residence, Humanitarian, Citizenship, Members of the Military and Their Family, Family, Visit the U.S., Working in the U.S, and Genealogy. After clicking on a specific topic, I was provided helpful information and even more additional information was available through the links on the left of the screen.The advantage of categorizing the information by topic is that individuals are now able to familiarize themselves with the process from start to finish. There are other helpful links and tools within each specific topic.
Another key feature to the Web site is that there is a “where to start” link. Before, individuals could navigate throughout the Web site not knowing where to even begin their search on a narrow issue. Now, the “where to start link” will allow individuals to begin their immigration search by narrowing it down to their specific issue. For instance, there is a scroll-down available for individuals under the “where to start” link. It states “I Am,” and one can select from the various choices available and get specific information relating to any issue.
Given the new era with text messaging (even various airline companies provide flight and gate status information through text messaging), USCIS has upgraded its site by adding a link that allows individuals to receive case status updates via text messages. The newly designed site has provided a one-stop resource center for individuals with specific queries and I am excited in navigating throughout their links. Can anybody help me out with regards to what documents need to be sent to the canadian embassy in newyork for a TRV (visitiors visa)?
Any one with any insight on how long does it take to get it back?
70 US$ for single entry
135 for multiple entry.
Request letter (i asked for visitor visa to meet friend)
Filled in form.
Employment letter from employer (I didnt send. they called and asked me to fax that)
Postage paid envelope for them to mail the passport back to you.
Proof of funds (bank statement copy) for the stay.
Its there in web page.
Any one with any insight on how long does it take to get it back?

Hi,
I have recently received an RFE on my I-485 application asking me to provide receipt number or A number for my spouse and child as I have included them in my application. I don't know how to respond to this and need your help to provide a suitable response.
I didn�t submit I-485 application for my spouse and child as they were out of the country while i filed my mine. My family continues to live outside US while I'm here working on H1 and also have my approved labor (Feb24 2007) EAD (Nov11 2007) and I-140(Feb10 2009)
Question is how to respond to RFE as I can't provide A number or receipt number. Also as my spouse and child are born in a country where they still have visa numbers available, can I claim cross chargeability to my spouse country of birth as the visa numbers are not yet available for India for my Priority date.
As I have my chances of speedy processing with cross chargeability, how should I respond to RFE without I-485 filed for my family? Is it possible to ask for consular processing for my family with an intend FTJ? Please help me to answer in a way that would help my processing faster.

My H1-B is expiring in December 2007. I have approved I-140 now and am hoping to get 3 year H1-B extension based on my approved I-140. Do you think I can get 3 year extension even if the visa numbers for filing AOS is current? Does AC21 apply to this case? Please suggest.

Here are the details:
Working with an employer since 2001, EB 3 PD Dec 2003, EAD in 2007, Still on H1b until Nov 10. Though had two masters i had filed under EB 3 (no one to balim it was just me...Small Company, not so called HR department and hired not so high profile/deligent lawyer (later found out that he was busy moving from west to east coast)
With the same employer, i have rec'd EB 2 approval, want to file I 140 and port EB 3 PD.
Need help/input with folloiwng from the gurus:
1) in EB 3 application the title is "Construction Engineer" with 4 lines of scope of work clarification with bachelors degree in civil engg. and no experience requirement. In EB 2 application, we have used same title "Construction Engineer" with 4 lines of scope of work, we had left 2 lines common (as earlier in EB3 application) and 2 new lines (related to environmental engg. since i have two env. engg. masters with BE in civil engg.)......this ad asked for MS in env. engg. or similar degree with no experience requirement.
Question: EB 2 Labor is approved, i am not sure what they check with i 140 application but does above sound reasonable (not that anything can be changed...but asking for an opinion here).
2) With premium processing, how long it takes to get I140 approved?
3) Do we just file for I 140 for EB 2 first, get it approved and then file letter/application ( i don't know the procedure/protocol) asking to port PD OR do we need file some sort of paper work with I140 to port PD.

I think this become a problem for USCIS. might be they have some political pressure "not to allot Visa" and I dont think they will reversed. That I say American dadagiri. Rules for others only not for them

I am in the exact same situation. I have already filed I-140/I-485 concurrently with the substituted labor. Now the dates are current I am filling another I-485 with my approved I-140. There is nothing wrong in what we are doing, as long we explain about the earlier filling and clarify the motive of the second filling. Eventually we should withdraw one of the two based on the outcome of substituted labor/I-140.

I just received a NOID for my 485(No LUD on the online status, received direct mail) saying that my underlying 140 is withdrawn and AC21 not filed. I have filed for AC21 last june (yes June 2009) along with my RFE (asking for G325a, Medical, Birth Certificate and 10th marksheet - this was during the Pre-adjudication time). My 140 was withdrawn by my employer as I had changed jobs under AC21 provisions(left employer in Jan 2009, filed AC21 in June 2009 and 140 withdrawn Dec 2009). Guess I will send the entire paper work again. I am EB3 India with Feb 2004 PD and I am no where near being current so I am trying to figure out if it is just me or is this the new scam that USCIS found to harass us!!!
PS: My friend who is from the same employer, similar case (Nov 2003, EB3 with AC21 filed) also got a NOID. He responded to it yesterday. Guys, post here if you also received the same.

Got a 221g (pink) from Chennai consulate because I have a Phd in biology. After almost 4 weeks the status on the website was updated to 'submit passport'. I have a couple of questions. If anyone who has gone through a similar situation, can answer, I would very much appreciate it..
1. I have been asked to submit the passport to VFS. How long did it take for passport to be returned with visa.
2. I have already gone through the security clearance. Do I need to go through PIMS clearance again?
Please...appreciate responses from those who have gone through this themselves..

My only question with your scenario is the how did you think that even without the current scenario of frontlog how can you expect to receive the I-485 receipt in one week.
Based on your timeline your PD will be current in Nov, and you can still file after your return, why take chances.

Now that the economy is in the toilet, it looks like people in H-1B will have to pay for it.
An ignorant group of people don't understand that the world has now changed. They can kick out all the H-1Bs or shut-down the whole H-1B category, but it won't make the U.S. any better. The companies will just start opening offices offshore and more jobs will be lost.
I am just awfully frustrated to see the fact that whenever something goes wrong in this country, the legal immigrant community will have to pay the price.

In case of death: None, unless enough points are there and a child less than 16 years or non working spouse over 60 years.
I was trying to intrepret social security benefits at www.ssa.gov.
It reminded me, what my wife's doctor told us 3-4 years ago (my wife is with the same doctor for the last 6-7 years) � some people in US want to have a child born, when they are getting old � it took me 3-4 years to understand.
Here is story - My wife take X class of medicines due to diabetes (I think this means medicines can adversly harm growth of a child during pregnency). So doctor was trying to explain, whenever we want to have child what precaution we have to take and how they help in this type of situations. We asked doctor- how could we think of having another baby, when our kids are grown up, one finished MS, the other one is doing BS. Doctor�s reply was that some people in US want to have a child born, when they are getting old � there are reasons.
After interpreting SSA pages, I think, now I understand economic part of having child in old ages. If Mr A has accumulated enough social security points, Mr. A�s wife is not working, she is of 44 years and she becomes mother, this child is like insurance. If case of death of Mr. A, wife of Mr. A and Child of Mr. A will keep on getting social security benefits (this is up to 16 years). At the age of 60 (minimum age, when one can get Social Security benefits), Mr A�s wife can start getting her own Social Security benefits.
Getting term (life) insurance is not possible without GC. Three agents tried to help me at different times, they did not succeed � perhaps US lawas are like that. Thinking negatively getting GC may be long wait 5 years, 10 years, 20 years, even 30 years.
Just wondering, is it a common practice to have a child born in old ages as an insurance? Whether H1B people and people at GC path are aware of it?
For me this interpration is a learning and wanted to share it.
